TERMS OF USE (TOU) – LIMITED COMMERCIAL LICENSE

By downloading products from KayDesignZ.com, including freebies, you agree that the file or files that you received are copyrighted by KayDesignZ and licensed to you as a single user. All KayDesignZ products are copyrighted property and are licensed--not sold--to you. They do not become your property.

A Limited Commercial License allows photographers, scrappers-for-hire, and web/BLOG designers to use KayDesignZ.com products in projects for their clients. Please note that this Limited Commercial License is for small business, sole proprietors only. It is not for large businesses or redistributors.

With a Limited Commercial License for KayDesignZ.com products...


YOU MAY


Use KayDesignZ.com products in your small photography or design business as outlined below:

- for your personal design projects,

- to create projects for your customers provided that they only receive the final and flattened versions of the products (i.e. the final printed products or jpg/png files only--NO PSP/PSD files or individual paper or element files contained within the KayDesignZ.com product, etc.)

- to display samples of your work using KayDesignZ.com products in your galleries or portfolios. Credit in product previews or descriptions is not required, but appreciated. Credit in the TOU is required.

- on the Internet, including, but not limited to galleries, BLOGs, and EBay pages, which requires credit to KayDesignZ.com on each page where graphics appear. An appropriate attribution would be “graphics/name of product created by www.KayDesignZ.com.”


YOU MAY NOT


- claim any graphics as your own work, whether in their original state or in an altered state,

- distribute KayDesignZ.com products in any format except as outlined above. KayDesignZ.com products must never be used to design templates that will be sold on any CD, website, EBay, or in any other form,

- print, or have printed, KayDesignz.com papers/elements for sale or distribution via the internet, EBay, kits, retail locations or at any other venue,

- share these files with anyone, including family, friends, and clients, etc. If they wish to use these products, either personally or commercially, then they must purchase their own product and/or license,

- sell KayDesignz.com individual graphics in their purchased format. You can only create a completely new product for the purpose of selling individual items that you have created,

- produce projects for mass production or distribution. A Limited Commercial License allows for SMALL BUSINESS USE ONLY,

- use any products for obscene, defamatory, or immoral works or for any other purpose that is prohibited by law.

LIMITATION OF LIABILITY

Under no circumstances shall KayDesignZ be responsible for any damages or losses that result from the use of, or inability to use any of the products sold or distributed by KayDesignZ. All products and accompanying materials, if applicable, are provided “as is” without representation, warranty, or condition of any kind, either express or implied, including, but not limited to the implied representations, warranties, or conditions or merchantability, or fitness, for a particular purpose. KayDesignZ does not represent or warrant that the content will meet your requirements or that its use will be uninterrupted or error free. The entire risk as to the quality and performance of the content is with you. Should the content prove defective, you, and not KayDesignz, assume the entire cost of all necessary corrections.

REFUNDS/EXCHANGES AND LIMITED WARRANTY:

KayDesignZ.com's entire liability and your exclusive remedy, with respect to any claims arising out of your use of the products, is no refunds. We will do everything else possible to remedy the situation by allowing you, upon request to KayDesignZ.com, to be permitted to download downloadable products again, at a location we will provide for you.
